1. Content.

KnowledgeWorks Foundation is not responsible for any Materials posted on the KnowledgeWorks Foundation public message boards, newsgroups, file areas and bulletin boards or on any other forum on this site (the "Public Area"). You agree not to post, upload, distribute or otherwise publish in the Public Area or any other forums or bulletin boards connected with KnowledgeWorks Foundation any Materials which are: libelous, defamatory, obscene, abusive, pornographic, threatening, or an invasion of privacy; an infringement of the intellectual property rights, including, but not limited to, copyrights and trademarks, of any person or entity; illegal in any way or which advocate illegal activity; an advertisement or solicitation of funds, goods, or services.

KnowledgeWorks Foundation does not and cannot review or monitor every posting made on its website and on the Public Area, and is not responsible for the content of such postings.

KnowledgeWorks Foundation reserves the right at all times to disclose any information necessary in its sole discretion to satisfy any law, regulation or governmental request, or to edit, refuse to post, or remove any information or Materials, in whole or in part, that in KnowledgeWorks Foundation's sole discretion are objectionable or in violation of these terms and conditions.

2. Rights.

You acknowledge that (i) KnowledgeWorks Foundation's website permits access to content that is protected by copyrights, trademarks and other proprietary (including intellectual property) rights ("Rights"), and (ii) that these Rights are valid and protected in all media existing now or later developed and (iii) except as is explicitly provided otherwise, your use of content shall be governed by applicable copyright and other intellectual property laws. You agree that you may upload to message boards or otherwise transmit on or through KnowledgeWorks Foundation's website only content that is not encrypted, content that is not subject to any Rights, or content in which any holder of Rights has given express authorization for distribution on KnowledgeWorks Foundation's website. By submitting content to any Public Area, you automatically grant &emdash; or warrant that the owner of such content has expressly granted &emdash; KnowledgeWorks Foundation the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed for the full term of any Rights that may exist in such content.

3. Screen Name.

You may not select or use a screen name of another person (unless it is also your name), or a name subject to the Rights of any person other than you. You also may not use a screen name that suggests the availability of content that KnowledgeWorks Foundation, in its sole discretion, considers to be: libelous, defamatory, obscene, abusive, pornographic, threatening, an invasion of privacy, illegal, or an advertisement or solicitation of funds, goods, or services. You will not attempt to conceal or disguise your screen name in any communication with or via KnowledgeWorks Foundation's website.

4. Conduct and Communication.

KnowledgeWorks Foundation may elect at its sole discretion to monitor some, all or none of the Public Areas of KnowledgeWorks Foundation's website for adherence to state and federal law. You agree to use KnowledgeWorks Foundation's website only for lawful purposes. Any conduct by you that in KnowledgeWorks Foundation's sole discretion restricts or inhibits any other subscriber, person or entity from using or enjoying KnowledgeWorks Foundation's website or another service will not be permitted and shall entitle KnowledgeWorks Foundation to immediately terminate membership without notice.

5. Notification of Claimed Copyright Infringement.

If you believe in good faith that information posted by a user on KnowledgeWorks Foundation's website violates your rights under U.S. copyright law, please contact us at diamondb@kwfdn.org, and include the following information:

  • The name, address, and electronic signature of the complaining party;
  • The infringing materials and their Internet location;
  • Sufficient information to identify the copyrighted works;
  • A statement by the owner that it has a good faith belief that there is no legal basis for the use of the materials complained of;
  • A statement of the accuracy of the notice and, under penalty of perjury, that the complaining party is authorized to act on the behalf of the owner.

6. Responding to a Claim of Copyright Infringement.

If you receive a notice of copyright infringement for material you have posted on KnowledgeWorks Foundation's website, please contact us at diamondb@kwfdn.org, and include the following information:

  • The subscriber's name, address, phone number and physical or electronic signature;
  • Identification of the material and its location before removal;
  • A statement under penalty of perjury that the material was removed by mistake or misidentification;
  • Subscriber consent to local federal court jurisdiction, or if overseas, to an appropriate judicial body.
